1. Introduction
This End-User License Agreement ("Agreement", "EULA") is a legal contract between Lintu Investments Oy, Business ID 3359228-4, Meri-Rastilan Tie 6 A 8, 00980 Helsinki, Finland ("Company", "we", "our", "us") и вами ("User", "вы").
By creating an account, accessing, or using our software, platforms, tools, reports, analytics, models, or any related services (collectively, the "Services"), you agree to be legally bound by this EULA, together with our Terms & Conditions, Privacy Policy, and Cookie Policy (collectively, the "Agreements").
If you do not agree, you must not use the Services.
2. Nature of Services and Disclaimer

• The Services consist of data, research, analytics, statistical models, and informational content.
• The Services do not constitute and must not be construed as investment advice, financial advice, legal advice, tax advice, or brokerage services.
• No license as financial services provider: Lintu Investments Oy is not authorized by the Finnish Financial Supervisory Authority (Finanssivalvonta) or any EU/UK/US regulator to provide investment services.
• You acknowledge that decisions made in reliance on the Services are at your sole risk, and the Company accepts no fiduciary duty or liability for such reliance.

3. Eligibility and Compliance
By using the Services, you represent and warrant that:

• You are at least 18 years of age and legally capable of entering into contracts.
• If using on behalf of an organization, you have full authority to bind that entity.
• Neither you nor any entity you represent is included on any sanctions or restricted party list issued by the European Union, EEA, UK, US, or UN.
• You will not use the Services in any way that would cause Lintu Investments Oy to violate applicable laws, regulations, sanctions, or export control rules.

4. License Grant
Subject to your compliance with this Agreement, we grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Services solely for:

• personal use, or
• internal business use (if licensed by your employer).

You may not:

• copy, modify, distribute, sublicense, resell, or create derivative works of the Services;
• reverse engineer, decompile, or attempt to extract source code;
• use the Services for unlawful purposes or in violation of financial market regulations;
• remove or circumvent digital rights management, security features, or disclaimers.

5. Intellectual Property

• All intellectual property rights in the Services, including software, platforms, databases, algorithms, models, trademarks, reports, and Deliverables, remain the exclusive property of Lintu Investments Oy or its licensors.
• Deliverables (such as reports or analytics outputs) may be used only as permitted under your license.
• Feedback, suggestions, or recommendations you provide may be used by us without obligation or compensation.

6. User Responsibilities
You agree:

• to provide accurate, complete, and lawful information when registering and using the Services;
• to maintain the confidentiality of your account credentials;
• to notify us immediately of unauthorized use;
• to comply with all applicable laws, including data protection, export control, and sanctions rules;
• to be solely responsible for your decisions and actions taken in reliance on the Services.

7. Risk Acknowledgement
You acknowledge and accept that:

• The Services are informational only, not a substitute for independent professional advice.
• Information may not always be accurate, complete, current, or uninterrupted.
• Market conditions may change rapidly and may render analyses outdated.
• Past performance, forecasts, or simulations are not indicative of future results.
• You remain solely responsible for all financial or strategic decisions made using the Services.

8. Limitation of Liability
To the fullest extent permitted by law:

• Exclusion of damages: We are not liable for indirect, incidental, consequential, punitive, or special damages of any kind (including lost profits, lost opportunities, data loss, or reputational harm).
• Liability cap: Our aggregate liability shall not exceed the greater of:
• total fees paid by you in the 12 months preceding the claim, or
• EUR 100.
• No guarantee of access: We do not warrant uninterrupted, error-free, or 24/7 availability of the Services, which rely on third-party hosting and infrastructure beyond our control.
• Third-party data: We are not responsible for accuracy, availability, or reliability of third-party content or external data sources.
• Nothing excludes liability for gross negligence, willful misconduct, or rights that cannot be excluded under Finnish or EU consumer law.

9. Data Protection
We process personal data in accordance with GDPR, the Finnish Data Protection Act, and our [Privacy Policy]. By using the Services, you consent to such processing.
10. Termination
We may suspend or terminate your access immediately if you:

• breach this Agreement,
• misuse the Services,
• provide false or misleading information,
• are reasonably suspected of being subject to sanctions or creating regulatory/reputational risk.

You may stop using the Services at any time. Termination does not entitle you to refunds, except where required by mandatory consumer law.
Refunds and Withdrawal Rights: Our services are digital and made available immediately after purchase or access. By accessing the Services (including downloading, streaming, or viewing content), you expressly acknowledge and agree that you lose the statutory 14-day withdrawal right under the Finnish Consumer Protection Act and EU Consumer Rights Directive. Except where required by mandatory law, payments are non-refundable.
Termination does not affect accrued rights or obligations.
11. Governing Law and Dispute Resolution
This Agreement shall be governed by Finnish law.

• Disputes shall be resolved by the courts of Helsinki, Finland, unless mandatory EU consumer law provides otherwise.
• EU consumers may alternatively bring proceedings in their home jurisdiction.
• Consumers may also use:
• The Finnish Consumer Disputes Board (Kuluttajariitalautakunta), or
• The EU Online Dispute Resolution (ODR) platform: https://ec.europa.eu/odr.

12. Amendments
We may modify this Agreement from time to time. Material changes will be notified via the website, dashboard, or email. Continued use of the Services after such notification constitutes acceptance of the revised Agreement.
13. Miscellaneous

• Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
• Severability: If any provision is held invalid, the rest remain enforceable.
• Assignment: We may assign or transfer our rights and obligations; you may not assign without our prior consent.
• Entire Agreement: This EULA, together with our Terms & Conditions, Privacy Policy, and Cookie Policy, forms the entire agreement between you and us regarding use of the Services.
• No Waiver: Failure to enforce a right does not constitute a waiver.
